Retraction and Correction Policy

Pursuant to New Jersey law, Consumer Litigation Group maintains this Retraction and Correction Policy.  N.J.S.A. § 2A:43-2 allows us to limit damages that may be caused by our news media services.  The law applies to “the owner, manager, editor, publisher, or reporter of any newspaper, magazine, periodical, serial, or other publication.”

Defamation

If a publication in our news media services allegedly defames you, please provide us in writing a document that details:

1)    Your identity;

2)    The facts supporting whether or not you are a public figure;

3)    Our statement of false facts in question;

4)    Why you believe our statement of false facts pertains to a purely private concern or legitimate public concern;

5)    Why our statement of fact is false;

6)    Why our statement of false fact is not substantial truth, un-neutral, fair reporting, and/or a fair commenting;

7)    How our statement of false fact exposes you to hatred, ridicule, contempt, or causes you to be shunned, or injures you in your business or trade;

8)    How you wish us to publicly retract the defamatory, statement of false fact; and

9)    How we can give you an equal forum in which to publicly correct our statement of false fact; and

10) A statement that our statement of false facts did not occur more than 1 year ago (see N.J.S.A. 2A:14-3).

If we have published a statement of false fact concerning a criminal offense, a loathsome disease, a matter incompatible with your business, trade, or profession, or serious sexual misconduct, please notify us at once so that we may begin public retraction and correction.

Consumer Litigation Group does not want to defame any person without a basis in law.  We will react quickly and efficiently to retract and correct any defamatory statement of fact brought to our attention.  We will provide a reasonable means of retraction and correction in our news media services.

False Light Intrusion

If a publication in our news media services allegedly casts you in false light, please provide us in writing a document that details:

1)    Your identity;

2)    The facts supporting whether or not you are a public figure;

3)    Our statement of false facts in question;

4)    Why our statement of fact is false;

5)    How our statement of false facts misrepresents your characteristics, conduct, or beliefs;

6)    Why our statement of false fact is not substantial truth, un-neutral, fair reporting, and/or a fair commenting;

7)    How our statement of false fact is highly offensive to a reasonable person;

8)    How you wish us to publicly retract the statement of false fact; and

9)    How we can give you an equal forum in which to publicly correct our statement of false fact; and

10) A statement that our statement of false facts did not occur more than 1 year ago (see N.J.S.A. 2A:14-3).

Consumer Litigation Group does not want to cast you in false light without a basis in law.  We will react quickly and efficiently to retract and correct any statement casting false light brought to our attention.  We will provide a reasonable means of retraction and correction in our news media services.

Privacy Intrusion

If a publication in our news media services concerns your alleged private facts, please provide us in writing a document that details:

1)    Your identity;

2)    The statement of private fact in question;

3)    Why our publication of private facts is offensive to a reasonable person;

4)    Why there is no legitimate public interest in the published private facts;

5)    Why the published private facts are not newsworthy or do not pertain to a legitimate public concern;

6)    A statement that the published private facts are not found in public records or, if the statement is found in government records, why those government records do not qualify as public records;

7)    A statement that you did not consent to the publication of private facts;

8)    How you wish us to publicly or privately retract the published private fact and to what extent we can remove the published statement of fact from the public record controlled by us; and

9)    A statement that our publication of the private facts did not occur more than 1 year ago (see N.J.S.A. 2A:14-3).

Consumer Litigation Group does not want to intrude on your privacy and publish private statements of fact without a basis in law.  We will react quickly and efficiently to retract and correct any statement of private facts brought to our attention.  We will provide a reasonable means of retraction and correction in our news media services.  In conjunction or in the alternative, we will quietly remove private facts we incorrectly published in consultation with you.

Publishing or Misappropriating Trade Secrets

Consumer Litigation Group recognizes and acknowledges that a trade secret consists of a formula, process, device, or compilation which you use in your business to gain a lawful advantage over your competitors who do not know or use your trade secret.  We also recognize and acknowledge that we may not acquire or appropriate a trade secret by improper means or publish a trade secret knowing that the person who gave us the trade secret acquired or appropriated it via improper means.

We will not publish trade secrets in our news media services that we improperly acquired or appropriated.  And, we will not publish trade secrets from sources who we know improperly acquired or appropriated them.

If a publication in our news media services concerns your alleged trade secrets, please provide us in writing a document that details:

1)    Your identity;

2)    The published facts revealing your trade secret in question;

3)    Why and how the published facts are your trade secret;

4)    How you wish us to retract the published trade secret and to what extent we can remove the trade secret from the public record controlled by us; and

5)    The steps you wish us to take to preserve the secrecy of the trade secret.

Consumer Litigation Group does not want to publish trade secrets without a basis in law.  We will react quickly and efficiently to remove from our news media services any trade secret brought to our attention.  In conjunction or in the alternative, we will quietly remove your trade secret we incorrectly published in consultation with you.

Copyright and Intellectual Property Agent for Notice

Consumer Litigation Group’s copyright and intellectual property agent for notice of claims of copyright, trademark, or other intellectual property infringement is Joseph A. Mullaney, III, Esq.  Please send any notice of dispute to him and include the following information:

1)    An electronic or physical signature of the person authorized to act on behalf of the owner of the alleged copyright, trademark, or other intellectual property interest;

2)    A description of the copyrighted work, trademarked, or other intellectual property interest that you claim has been infringed;

3)    A description of where the material located in our news media services  that you claim is infringement;

4)    Your address, telephone number, and e-mail address;

5)    A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright, trademark, or other intellectual property owner, its agent, or the law;

6)    A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the alleged copyright, trademark, or other intellectual property owner or authorized to act on the copyright, trademark, or other intellectual property owner’s behalf.

Consumer Litigation Group does not want to publish information that infringes on your copyright, trademark, or other intellectual property.  We will react quickly and efficiently to remove from our news media services infringing content or property brought to our attention.

Other Improper Content or Publication

If you believe Consumer Litigation Group has published, disseminated, or otherwise distributed facts, opinions, materials, property, or other content in our news media services without a basis in law or otherwise in violation of your rights, please contact us so that we may retract, correct, or otherwise remove offending content.  We will react quickly and efficiently to retract, correct, or remove from our news media services content that exists in violation of your rights.
