The Law Office of Dimitrios Kolovos, LLC filed a lawsuit on behalf of a Northeast Pennsylvania consumer against National Credit Adjusters, L.L.C. and three of its employees for unlawful debt collection practices. The lawsuit was filed in the Middle District federal court for Pennsylvania seeking damages and attorney’s fees and costs.
The Complaint alleges that National Credit Adjusters, L.L.C. and its employees violated the woman’s rights when it repeatedly contacted her after she stated in writing that she did not want any further contacts. “Consumers have the right to cease communications with consumer debt collectors,” says the woman’s counsel, Joseph A. Mullaney, III, “pursuant to the Fair Debt Collection Practices Act.” Mullaney advises, “When consumers no longer want to be contacted by out-of-control debt collectors, they should send a certified, return receipt requested letter to that effect.” If a debt collector continues to contact the consumer, he or she may have a cause of action against the debt collector.
