Dallas Jury Awards $1.5 Million for Racially-Charged Collection Harassment

The consumer debt collector, Advanced Call Center Technologies, LLC, alleged that Allen Jones of Dallas, Texas owed a consumer debt of less than $200.00. Allen Jones maintained that he did owe the alleged debt and that it had already been paid. Despite the dispute, Allen Jones, who is black, continued receiving telephone calls seeking payment. Ultimately, the debt collector left voicemails on Jones’ voicemail consisting of, for example:

“This is your motherf*cking wake-up call you little lazy a*s b*tch…” On another occasion: “Get your motherf*cking n*gger a*s up and go pick some motherf*cking cotton fields.” These two quotes are the tamest that can be reprinted in this attorney blog… not the worst.

Allen Jones sued under fair debt collection laws Advanced Call Center Technologies, LLC for damages. On Friday, May 28, 2010, a Dallas County jury awarded Allen Jones one of the largest verdicts known pursuant to fair debt collection laws. The jury awarded $50,000.00 in mental anguish and $1.5 million in punitive damages.

In retrospect, no amount of money serves as compensation when a black man is called the n-word and advised to pick cotton. But, the jury was trying to send a clear, unambiguous message to debt collectors: Violate the law, and you will pay.

    Once again the hubris of these out-of-control debt collectors is evident. “Racially-charged” is polite for the kind of collection techniques Advanced Call Center Technologies used. Even “harassment” doesn’t cover it. I hope this company got the $1.5 million message loud and clear.

    What century are these people living in? Using that kind of racially degrading language is unacceptable anywhere. To think so-called professional consumer debt collector, Advanced Call Center Technologies, LLC, would use this type of language is unbelievable.

    That’s just unbelievable.  I would hope that the debt collection company fired the employee that did that.  If it was someone in charge or in ownership, then the company should be shut down.  That is the most unprofessional attitude I’ve ever heard of.

    When a debt collection agency calls a person and starts using insulting language, he should immediately tape or take extensive notes and report the debt collector. Racially-charged language and slurs have no place in the professional world.

    It is difficult for me to believe that harassment along these racially-charged lines continues to occur in pockets throughout this country. While I don’t always side with people suing companies, if this consumer debt collector did a tenth of what it is charged with, then the man well deserves the million-dollar-plus settlement he was awarded. The company should not be allowed to continue operations.

    It is difficult for me to believe that harassment along these racially-charged lines continues to occur in pockets throughout this country.
